Terms of Service

You may register using an email address and password, or through a supported third-party authentication provider (currently Google). You must provide accurate and complete information during registration.

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized access to or use of your Account. We are not liable for any loss arising from unauthorized use of your Account.

Each individual may maintain only one Account. We reserve the right to merge or terminate duplicate accounts.

Xin Points are the virtual credit unit used to pay for AI generation tasks within the Service. Xin Points have no cash value and cannot be exchanged for currency outside the Service. The exchange rate is approximately 1 Xin Point = US $0.01.

Upon registration, new users receive a one-time welcome bonus of Xin Points. This bonus is non-transferable and subject to change.

You may purchase Xin Points through one-time credit packs or through a Subscription plan. All payments are processed by Stripe, Inc. and are subject to Stripe's terms of service.

Prices for AI generation tasks are measured in Xin Points and vary by model, duration, resolution, and other parameters. We reserve the right to adjust pricing at any time. Price changes do not affect Xin Points already purchased.

If an AI generation task fails due to a platform error (not user input), the Xin Points consumed will be automatically refunded to your Account. Xin Point purchases are generally non-refundable except as required by applicable law. For Subscription refund requests, please contact our support team.

Xin Points cannot be converted to cash, transferred to other users, or redeemed outside the Service. Unused Xin Points have no expiration date, subject to Account standing.

We offer multiple Subscription tiers (e.g., Basic, Pro, Ultimate, Max), each providing a monthly allocation of Xin Points and tier-specific benefits such as increased concurrency limits and resolution caps.

Subscriptions are billed on a monthly recurring basis. Your Subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

You may cancel your Subscription at any time through your Account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Subscription benefits until the period ends.

When you downgrade or change your Subscription tier, the new tier takes effect at the start of the next billing period. Unused monthly Xin Points from the current period do not carry over differently; they remain in your balance.

You retain ownership of the Content you upload to the Service (e.g., reference images, prompts, canvas layouts). By uploading Content, you grant us a limited, non-exclusive, worldwide license to process, store, and display such Content solely for the purpose of providing the Service to you.

Subject to these Terms, you own the Generated Content created through your use of the Service, to the maximum extent permitted by applicable law. You are solely responsible for ensuring that your use of Generated Content complies with applicable laws and does not infringe upon third-party rights.

Generated Content is produced by third-party AI models. We do not guarantee that Generated Content is unique, original, or free from similarity to existing works. You acknowledge that identical or similar prompts may produce similar outputs for different users.

The Service, including its software, design, trademarks, and documentation, is owned by us and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

When using face reference features (e.g., uploading real human face images for AI video generation), you represent and warrant that:

• You have obtained explicit, informed consent from the individual whose face is depicted in the reference material
• You are the individual depicted, or you have documented written authorization from that individual to use their likeness
• The use does not violate any applicable laws regarding personality rights, publicity rights, or privacy rights

You must not use face reference features to:

• Create non-consensual intimate or sexual imagery of any person
• Generate content depicting minors or individuals who appear to be minors
• Impersonate public figures or celebrities without authorization
• Create deceptive or fraudulent content intended to mislead others about a person's actions or statements
• Harass, bully, or defame any individual

Violations of this section will result in immediate Account suspension and permanent ban. We may report violations to law enforcement authorities where appropriate.

We employ automated systems to review Content and Generated Content for compliance with our policies, including NSFW detection and content safety checks.

Certain AI models (e.g., Seedance 2.0) require reference assets to pass compliance verification before generation. Assets that fail compliance checks cannot be used for generation with those models.

We reserve the right to remove any Content that violates these Terms or our policies, with or without notice. Repeated violations may result in Account suspension or termination.

If you believe that any Content on the Service infringes your copyright, you may submit a takedown notice to our designated agent at:

Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Service; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; (e) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on behalf of one; and (f) your physical or electronic signature.

To report any Content that violates these Terms, including non-consensual deepfakes, unauthorized use of likeness, or other harmful content, please contact us at:

We will investigate all reports and take appropriate action, which may include removing Content and terminating the responsible Account.

If you believe your Content was removed in error, you may submit a counter-notification with the required information under applicable law. We will restore the Content within 10-14 business days unless the complainant initiates legal action.

You may close your Account at any time by contacting our support team. Upon closure, your right to use the Service terminates immediately. Any remaining Xin Points balance is forfeited and non-refundable.

We may suspend or terminate your Account at our discretion, including for violations of these Terms, fraudulent activity, extended inactivity, or as required by law. We will make reasonable efforts to notify you before termination, except where prohibited by law or where immediate action is necessary.

Upon termination, your license to use the Service ceases. We may delete your Content and Account data in accordance with our Privacy Policy. Provisions that by their nature should survive termination shall survive, including Sections 7, 14, 15, 16, and 18.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where XinYu AI is registered, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may submit the dispute to binding arbitration or the courts of competent jurisdiction.
